



Ohio law is clear: every retail sale, including those to out-of-state (nonresident) buyers, must result in an Ohio-issued certificate of title, or nonresident title, in the buyer’s name. According to O.R.C. 4505.06(4),
In the case of the sale of a motor vehicle to a general buyer or user by a dealer… the certificate of title shall be obtained in the name of the buyer by the dealer… upon application signed by the buyer.
The phrase “general buyer or user” is intentionally broad. It applies to all retail buyers, regardless of residency.
Whenever Chapter 4505 refers to a “certificate of title,” it’s referring to a title issued under Ohio law by an Ohio Clerk of Courts.
A nonresident title is still an Ohio title; it simply lists the buyer’s out-of-state address.
Dealers cannot skip titling simply because the buyer is an out-of-state resident; the obligation remains the same for both Ohio residents and nonresidents.
Why the titling requirement is often misunderstood and/or abandoned
The root of the confusion is not the law itself — it’s how other states read Ohio titles.
Most states define a “new” vehicle as one that has never been titled. When another state sees “Prior Title: Ohio,” the vehicle is automatically classified as used. This is not Ohio’s intent, but rather a byproduct of how interstate title databases interpret title history.
Since Ohio law mandates issuance of a title before the vehicle leaves the state, the vehicle may appear “used” to the buyer’s home BMV/DMV — even though it is brand new, with full manufacturer warranty.
Issuing an Ohio title for a resident or nonresident fulfills the dealer’s legal duty. While another state may classify the vehicle differently for tax or registration purposes, it does not change the vehicle’s actual new status for warranty, rebate, or manufacturer reporting.
Compliance and risk if you skip titling
Temporary Tag Requirements (R.C. 4503.182)
- A temporary tag creates a statutory expectation that an Ohio title will follow.
- Issuing a tag without filing a title application violates R.C. 4503.182.
- Possible penalties include suspension of tag privileges or print-on-demand access.
Sales Tax Risk (R.C. 5739.029 – STEC-NR Form)
- Nonresident transactions are a major audit focus for the Department of Taxation. Missing STEC-NR forms or unfiled nonresident titles are common violations.
- Forms and fees are filed at the time of title issuance by the Clerk of Courts.
- Without an Ohio nonresident title and completed STEC-NR form, the sale is presumed taxable in Ohio.
- The dealer becomes liable for sales tax, interest, and penalties, even if the buyer later titles it elsewhere.
Ohio adopted this requirement decades ago to ensure sales tax compliance through STEC-NR documentation and to maintain a title record for every retail transaction handled by an Ohio dealer.
Ohio’s priority is recorded ownership and tax control, even if that occasionally creates administrative complications for the buyer’s home state.
